  9. Message content proposal

  11. The FCC has proposed to change the responsibility for the content of
  12. amateur messages relayed by high-speed networks.
  13.  
  14. On March 22, 1993, the Commission announced action in Docket 93-85,
  15. in Notice of Proposed Rule Making 93-154, proposing to establish "a
  16. compliance policy for amateur stations participating in automatic
  17. message forwarding systems, to hold the licensee of the station
  18. originating a message and the licensee of the first forwarding
  19. station primarily accountable for violative communications.

  21. "Under this approach," the FCC said, "licensees of stations that
  22. only retransmit messages within a high speed message forwarding
  23. system would not be held accountable for communications they forward
  24. or their stations retransmit unwittingly.

  26. "Under the current rules," the FCC said, "each amateur licensee is
  27. fully responsible for assuring that the contents of every
  28. transmission from his or her station complies with the rules.  This
  29. requirement was not a burden when licensees sent each message
  30. manually.  With the availablilty of digital technology, however,
  31. some licensees have tied their stations together into high volume,
  32. high speed message forwarding systems.  The stations are configured
  33. so that each message is instantly retransmitted to its destination
  34. through a series of stations.

  36. "Because message screening is difficult with these automatic systems
  37. and because screening at each station in these systems diminishes
  38. the advantage of high speed, the Commission proposed holding
  39. accountable only the licensee of the originating station and the
  40. licensee of the first station in a high speed message forwarding
  41. system."
